Privacy Policy

Effective Date: July 2026

1. Introduction

Welcome to PE Elevate, a product of BirdieIns (Datalyca Inc / Datalyca Technologies Pvt Ltd). We are deeply committed to protecting the privacy and security of our users, which include schools, educators, and most importantly, students. This Privacy Policy details how we collect, use, disclose, and protect information when you use our mobile applications, website, and AI-powered assessment platforms.

2. Information We Collect

We collect information strictly necessary to provide and improve our physical and cognitive assessment services:

  • School & Educator Data: Names, email addresses, school affiliations, and contact information provided during account creation and demo requests.
  • Student Data: Basic identifiers (such as name, grade, age, and gender) required to benchmark physical performance accurately against universal standards.
  • Assessment & Performance Data: Metrics related to fitness tests, VO₂ max scores, agility, core strength, and house points.
  • Visual & AI Processing Data: Temporary video or image data captured via smartphone cameras during physical assessments. Note: These are processed to analyze posture, gait, and speed.

3. How We Use Your Information

PE Elevate uses the collected data exclusively for educational and platform-related purposes:

  • To generate accurate, AI-driven physical and cognitive assessment reports for students.
  • To automate school curriculums, PET schedules, and inter-house sports events.
  • To provide actionable insights to teachers and school administrators regarding student health and athletic development.
  • To improve our Computer Vision algorithms (data used for algorithm improvement is strictly anonymized and de-identified).

We DO NOT sell, rent, or trade student data to third parties, nor do we use student data for targeted advertising.

4. Student Privacy & Compliance

Protecting student privacy is our highest priority. PE Elevate acts as a "School Official" under the Family Educational Rights and Privacy Act (FERPA) and complies with the Children's Online Privacy Protection Act (COPPA) in the United States, as well as applicable regional data protection laws (such as the DPDP Act in India).

We only collect personal information from children under 13 when a school or district has authorized us to do so and provided the necessary consent on behalf of parents.

5. Data Security, Access Control & AI Privacy

We implement enterprise-grade technical safeguards and zero-trust security controls to ensure all school and student information remains strictly confidential:

Military-Grade Security

Enterprise-level protection using AES-256 encryption at rest and secure cloud vaults to protect all records against unauthorized access.

Encrypted Communications

Full end-to-end encryption in transit via TLS 1.3 cryptographic protocols, ensuring data cannot be intercepted over the network.

Automatic Face Blurring

Edge/pre-processing privacy algorithms automatically detect and obscure faces in real time before AI motion analysis occurs.

School-Owned Data

Institutions retain 100% data ownership and sovereignty; records are strictly isolated and accessible solely by the authorized school.

Role-Based Access Control (RBAC)

Granular permission profiles ensure staff, PET teachers, and administrators only view assessment metrics permitted for their role.

OTP Authentication

Multi-factor and dynamic One-Time Password (OTP) verification systems prevent credential sharing and unauthorized account logins.

Geofenced Access

Perimeter-based access controls restrict assessment testing and report access to designated, approved school campus grounds.

Time-Based Access

Operational window locks enforce session cut-offs and restrict sensitive data views strictly to designated school working hours.

6. Data Retention, Ownership & Deletion Control

We adhere to strict data lifecycle controls to keep institutions in complete control over their records:

  • Data Deletion Control: Authorized school administrators can initiate on-demand data purges to permanently wipe or de-identify student records at any time.
  • Subscription Lifespan: Data is maintained only for the active duration of the school's contract with PE Elevate or as required by regulatory compliance.
  • Standard Purge Timelines: Following account closure or contract termination, remaining student data is irreversibly wiped from production backups within standard operational timelines.

7. Sharing of Information

We only share information under the following strict conditions:

  • With the School: Teachers and administrators have access to their respective students' reports and data.
  • Service Providers: Trusted third-party cloud hosting providers who are legally bound to strict data confidentiality agreements.
  • Legal Requirements: If required to comply with a valid legal subpoena or court order.

8. Changes to This Policy

We may update this Privacy Policy periodically to reflect changes in our practices or legal obligations. We will notify partner schools directly of any material changes via email or platform notifications before the changes take effect.
